Count Date Records (beginning with 2008-09)
Immigrant (Title III) is an indication of whether a student qualifies as an immigrant under Title III, Section 3301 (6) of the NCLB.
CHANGES: Definition of 'Not born in US' was clarified by USDE for 2009-10. Immigrant (Title III) is collected for the first time in ISES Count Date records for 2008-09. Immigrant (Title III) may be auto-generated when no data is provided.
Three criteria1 must be met in order for a student to qualify as an immigrant under the definition specified by the NCLB:
- Aged 3-21 as of the Third Friday of September.
- Not born in US.
- In US schools for less than 3 consecutive full academic years.

USES: Federal funding is based in part on counts of students qualifying as immigrants based on the above criteria. In this case, English language proficiency is not a factor. Data about student status as an immigrant are also required by the U.S. Department of Education for some disaggregated reporting.
ANSWERS TO QUESTIONS ABOUT IMMIGRANT (TITLE III)
- DPI does not collect information on the legal basis for any students current residence in the US (e.g. citizenship status, permanent residency, visas, etc.).
- Students adopted by U.S. citizens and foreign exchange students may have Immigrant (Title III) code Y if they meet the above three criteria.
- DPI does not require information on where a student was born outside the US; if the 'ZZ' code is used, the birth city may be provided (and used for WSLS matching purposes only) or listed as UNKNOWN.
- According to the USDE, students born in the territories of the United States other than Puerto Rico are not considered born in the US for purposes of determining immigrants under Title III. These territories include American Samoa, Guam, Marianas Islands, and U.S. Virgin Islands. These students are considered 'not born in the US'. Children born outside the US to military personnel and children born outside the US and adopted by US citizens are considered 'not born in the US'.
- Immigrant (Title III) may be auto-generated when no data is provided and birth state, age and years in US schools meet the Title III definition.
